Trading Terms and Conditions

Every effort has been made to ensure that all information on this site is accurate PMCA takes no responsibility for errors or omissions - particularly with other web pages linked to this site. Placing an order confirms acceptance of these trading conditions and terms of business. The following conditions apply to and are deemed to be incorporated in all contracts for the supply of services and materials. They specifically exclude any terms and conditions proffered by the client. 

1 COPYRIGHT. The Copyright, Designs & Patents Act 1988.) The copyright of all designs, rough layouts, sketches, visuals, finished artwork and final product is the property of Pete Mallinson Commercial Art (PMCA). You cannot re-print, copy, electronically store and retrieve or otherwise reproduce any material without prior consent in writing. Click HERE for more information. 
   It is the clients responsibility to ensure that all materials presented for use are free from any third party claim of copyright. The client hereby indemnifies PMCA against all costs, claims, damages and losses of whatsoever nature arising from any claim by any third party in respect of alleged infringement of copyright in any material supplied to PMCA or any claim arising out of the possession of such material or any reproduction thereof or arising in any other way whatsoever from the production undertaken by PMCA in accordance with the clients instructions or on the clients behalf.

2 CONFIDENTIALITY. (Breach of Confidence - Common Law.) All ideas, proposals, discussions, conversations, meetings, presentations, correspondence, telephone calls, faxes, e-mails, visuals and all other communications are deemed to be private and ‘in confidence’. 

3 TELEPHONE & VERBAL INSTRUCTIONS. PMCA cannot accept responsibility for errors arising from verbal or telephone orders, amendments, corrections or instructions that are not confirmed in writing before the work is commenced.

4 DELIVERY. Any stated delivery date constitutes only a warranty by PMCA to use reasonable endeavours to effect delivery by or about that date. No liability will be accepted for failure to meet delivery dates, however caused. 

5 PAYMENT. Payment must be made by the 30th day following the date of the invoice. Interest may be charged at 4% per month over the base rate of The Bank of Scotland on accounts not settled within PMCA's terms of payment. Invoice queries which go beyond 30 days from the date of issue will not be accepted. Any costs incurred in collecting an overdue account will be charged directly to the client.

6 CLAIMS. Any goods rejected as not complying for whatever reason with the order placed must be so rejected in writing within 72 hours of receipt by the client or his/her agent. Distribution or use of the goods in any way whatsoever is an implicit acceptance of the completion of the contract. PMCA shall be under no liability whatsoever for any consequential loss or damage, costs, expenses, loss of profit, or other claims arising out of the goods use or resale. In cases of complaint it is necessary that all relative work be returned in its entirety together with the invoice.

7 ADDITIONAL CHARGES. Estimates and prices are based on current costs of labour and materials and may be subject to alteration. All items not mentioned in the original job description will, of course, be charged extra.

8 TITLE. The goods remain the property of PMCA until payment in full, including any interest, has been paid.
